These Terms of Service (“Terms”) govern the access and use of the websites, mobile applications, and services (collectively, the “Services”) provided by KweGO Financial Services Technology Limited (“KweGO”, “we”, “our”, or “us”), a company registered with the Financial Transactions and Reports Analysis Centre of Canada (FINTRAC) as a money services business (MSB). By registering for or using our Services, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws in Canada, Nigeria, and any jurisdiction where you access our Services. If you do not agree, do not use the Services.

2. Eligibility
- You must be at least 18 years of age (or the age of majority in your jurisdiction).
- You must have the legal capacity to enter into binding contracts.
- You must not be located in a jurisdiction subject to sanctions (as per Canadian, U.S., U.K., EU, or UN sanctions lists).
3. Account Registration and Verification
- To access our Services, you must register an account and provide accurate and complete information.
- As part of our compliance with PCMLTFA (Canada) and NDPR/CBN rules (Nigeria), we conduct KYC/AML verification using Sumsub Solutions Inc., a third-party identity verification provider.
- You consent to the collection, processing, and verification of your information by Sumsub and other authorized third parties.
- KweGO reserves the right to approve, suspend, or terminate accounts at its discretion.
4. Services Provided
KweGO provides:
- Peer-to-Peer (P2P) Forex Trading Platform enabling users to buy and sell supported currencies.
- Wallet and Payment Processing services (via KweGO in Canada, Flutterwave in Nigeria).
- KYC/AML Verification and fraud prevention services (via Sumsub).
- Value-added services such as transaction tracking, dispute resolution, and customer support.
We may update or modify our Services from time to time.
5. User Responsibilities
You agree to:
- Use the Services only for lawful purposes.
- Comply with FINTRAC, CBN, and other applicable regulations.
- Not engage in prohibited activities including fraud, money laundering, terrorist financing, or sanctions evasion.
- Provide accurate information for KYC, transactions, and communications.
- Be solely responsible for your account and transactions.
6. Transactions
- P2P transactions are binding once confirmed by both parties.
- KweGO acts as a facilitator only and is not a counterparty to P2P trades.
- Payments in Nigeria are processed securely via Flutterwave.
- Users are responsible for complying with tax, foreign exchange, and financial regulations in their jurisdictions.
- Disputes must first be submitted to KweGO’s dispute resolution system.
7. Fees
Transaction fees, processing charges, and service costs are disclosed before confirmation of a trade. Fees are subject to change with prior notice.
8. Risk Disclosure
- Forex trading and financial transactions carry significant risks, including the potential for losses.
- KweGO does not provide investment advice, financial advice, or legal advice.
- You acknowledge and accept full responsibility for risks associated with your use of the Services.
9. Data Protection and Privacy
In Canada, we comply with PIPEDA and PCMLTFA record-keeping requirements. In Nigeria, we comply with the NDPR and CBN guidelines. KYC and identity verification are handled via Sumsub. Payment processing is handled by Flutterwave (Nigeria) and Canadian banking/payment partners. See our Privacy Policy for full details.
10. Suspension and Termination
We may suspend or terminate accounts if required by FINTRAC, CBN, or law enforcement; you breach these Terms or provide false information; or we detect suspicious, fraudulent, or prohibited activity.
11. Limitation of Liability
KweGO is not responsible for losses from user-to-user transactions, service disruptions, technical errors, downtime, or losses resulting from third-party providers (e.g., Flutterwave, Sumsub). Our total liability shall not exceed the fees paid to us in the 12 months prior to the claim.
12. Dispute Resolution
Disputes will first be resolved via KweGO’s internal system. If unresolved, disputes involving Canada users shall be governed by the laws of Ontario, Canada and subject to binding arbitration in Toronto. Disputes involving Nigeria users shall be governed by the laws of the Federal Republic of Nigeria and subject to arbitration in Lagos.
13. Governing Law
These Terms are governed by Canadian law for Services delivered in Canada and Nigerian law for Services delivered in Nigeria.
14. Amendments
We may modify these Terms periodically. Continued use of the Services constitutes acceptance of revised Terms.
